Herrick Litigation partner, Andrew J. Wagner, was quoted in a Brick Underground article providing guidance on what steps an apartment owner can take after they were accused by their co-op board of illegally subletting their apartment.

The article noted that while it depends on how a board is alleging a shareholder has an illegal subletter, they usually just want an explanation, and open and clear communication is key. "It's better for both sides to get their facts straight and resolve this," said Andrew.

If you did have a guest, it’s best to let your board know about your plans ahead of time. Your co-op board may ask you to provide information about your guest or roommate for security purposes, Andrew added.
