Kaplan represents Fortune 500 manufacturers, corporations, retailers and privately owned businesses in complex product liability litigations, general commercial claims, corporate disputes, due diligence investigations and construction matters. He also represents clients in connection with insurance and reinsurance matters in both litigation and arbitration. In addition to his handling of general litigation matters for business clients through trial and appeal, Alan counsels clients through negotiations and mediations as an alternative to litigation where warranted. Herrick's clients rely on Alan's talent for thinking "outside the box" and resolving difficult and unusual disputes.
Alan has served as regional trial counsel for several companies and has been involved with well over 100 trials and reported decisions. He also counsels clients in investigations by the Consumer Product Safety Commission, the Food and Drug Administration and the Department of Transportation.
Alan co-chairs the firm's Product Liability Practice. Previously, he was Chairman of the Automotive Product Liability Committee's National Institute for the American Bar Association. He is presently a member of the Defense Research Institute and a member of the Legal Task Force of the Sporting Goods Manufacturers Association. In addition, he is a frequent contributor to various product liability publications.
