Herrick's Title Insurance Litigation Group represents all of the major title insurance companies that do business in New York and New Jersey on coverage issues and claims asserted against their insureds, including defending attacks on title or the ability of a mortgage lender to foreclose. Many of these cases involve fraudulent and criminal practices which give rise to title problems and claims.
We also often represent the title company itself in cases involving fraud or defalcation of closing funds or proceeds, working closely with federal and state authorities to investigate the fraud and recover the stolen proceeds.
