Commercial Landlord - Illegal "Repossession"

Representation of a commercial landlord in a lawsuit against a purported secured creditor which began "repossessing’ fixtures attached to the premises. After successfully obtaining an emergency order from the Supreme Court of the State of New York enjoining any further "repossession" and compelling the return of fixtures already removed, the purported secured creditor appealed. The Appellate Division, Second Department affirmed the Supreme Court’s decision. (Romonoff Restaurant & Cabaret, Inc. v.
